§1 General Provisions
- The owner of the Service at ateliertwentyone.eu/pl is ATELIER TWENTYONE LIMITED LIABILITY COMPANY, with its registered office in Witkówek, Witkówek 6, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court FOR WROCŁAW FABRYCZNA, IX Commercial Division of the National Court Register under KRS number 0001097709, NIP: 6912577494, REGON: 528247401, share capital of 500,000.00 PLN.
- The Regulations set out the rules for using the Service and its functionalities, including the type and scope of services provided, including electronic services provided by its owner, the terms and conditions for placing orders, technical requirements, the manner of concluding and terminating distance contracts, rules and deadlines for payments, delivery conditions, and the complaint procedure.

§2 Definitions
- Price – the value expressed in monetary units that the Customer is obliged to pay the Seller.
- Business day – a weekday from Monday to Friday, excluding public holidays.
- Delivery – means providing the Goods to the Customer by the Seller.
- DSA – Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a Single Market for Digital Services and amending Directive 2000/31/EC (Digital Services Act).
- Civil Code – the Civil Code Act of 23 April 1964.
- Customer – an entity making a Purchase of goods for its own consumption and acquiring ownership rights or intending to purchase. A natural person with full legal capacity, and in cases provided for by generally applicable law also a natural person with limited legal capacity, a legal person, and an organizational unit without legal personality to which the law grants legal capacity – who has concluded or intends to conclude an Agreement with the Seller.
- Consumer – a natural person performing a legal act with an entrepreneur not directly related to his/her business or professional activity (definition based on Art. 22(1) of the Civil Code).
- Offer – a proposal of Products available in the Service, including essential information about the Product or Service. The Offer may also include instructions for use or detailed conditions of using a given function (if available).
- Privacy Policy – a document defining the rules for processing personal data, available at https://ateliertwentyone.eu/pl/polityka-prywatnosci.
- Product – any Goods or Service within the meaning of Art. 2 pt. 3 of the Act on Counteracting Unfair Market Practices; the Product is payable unless stated otherwise.
- Physical product – a product subject to physical shipment by mail/courier or available for personal collection.
- Entrepreneur – a natural person, legal person, or organizational unit not being a legal person to which a separate act grants legal capacity, conducting business activity on its own behalf, using the Service.
- Entrepreneur with consumer rights – a natural person concluding a contract directly related to their business activity, where the content of the contract indicates that it does not have a professional character for them, particularly arising from the subject of their business activity made available under the Central Registration and Information on Business regulations.
- Regulations – these Sales Regulations defining the rules of using the Service, placing orders, and the rules of order fulfillment by the Seller.
- Service – the website ateliertwentyone.eu/pl, where the Seller conducts the sale of Products.

- Goods – an item being the subject of a contract concluded between the Seller and the Customer.
- Agreement – mutual arrangements between the Seller and the Customer defining mutual rights and obligations.
- Distance contract – a contract concluded without the simultaneous physical presence of the parties, exclusively using one or more means of distance communication up to and including the conclusion of the contract.
- Service – any activity containing an element of immateriality, consisting of influencing the Customer or their items, which does not involve transferring ownership rights.
- Electronic service – a service provided electronically through the Service; a service within the meaning of Art. 2 pt. 4 of the Act on the Provision of Electronic Services.
- User – an entity using the Service.
- Purchase – the transfer of ownership to the Customer, for payment or free of charge.
§3 Technical Requirements
- In order to properly and fully use the Service, the Customer should meet the following technical requirements:
- possess a device with Internet access,
- use an up-to-date web browser,
- enable cookies and JavaScript in the browser.
- The Service may use software securing against automated actions (anti-bot solutions). Their use may involve verifying whether the actions are performed by a human, such as reCAPTCHA.
§4 General Terms of Use
- The Service is available 24/7, except for interruptions due to technical work, breakdowns, or force majeure.
- Use of the Service is free of charge, however placing an order requires payment for the Product in accordance with the Price indicated.
- The Customer is obliged to provide truthful and current data, necessary to fulfill the order.
- The Customer is obliged to use the Service in a manner consistent with the law, these Regulations, and good customs, and not to supply unlawful content.
- In particular, it is prohibited to:
- take actions that may disrupt the functioning of the Service,
- use the Service for purposes contrary to the law,
- send unsolicited commercial information (spam) through the Service.
§5 Placing an Order
- Orders can be placed via the Service 24/7, excluding technical interruptions.
- Placing an order requires:
- choosing the Product,
- providing required data,
- accepting the Regulations,
- confirming the order by using the “Order and Pay” button (or equivalent).
- After placing the order, the Seller confirms its receipt by sending an email to the address provided by the Customer.
- The contract is concluded at the moment the Seller confirms the order.
§6 Prices and Payment Methods
- All prices of Products are given in Polish zloty (PLN) and include VAT, unless otherwise stated.
- The Seller reserves the right to change Prices; however, the change does not apply to orders already placed.
- The Customer may choose one of the following payment methods:
- bank transfer,
- electronic payment (via the payment operator indicated in the Service),
- payment card.
- In case of non-payment within 7 days, the order will be canceled.
§7 Delivery
- The delivery of Physical Products is carried out on the territory of Poland, unless otherwise indicated in the Offer.
- The Customer may choose the method of Delivery indicated in the Service, such as:
- courier service,
- parcel locker,
- personal collection.
- The delivery costs are borne by the Customer, unless the Offer states otherwise.
- The time of order fulfillment is indicated in the Product description. If several Products with different delivery times have been ordered, the order is fulfilled within the longest of them.
§8 Right of Withdrawal
- The Consumer has the right to withdraw from a distance contract within 14 days without giving any reason.
- The withdrawal period expires after 14 days from the date on which the Consumer came into possession of the Goods, or in the case of Services, from the date of contract conclusion.
- To exercise the right of withdrawal, the Consumer must inform the Seller of their decision by means of an unequivocal statement (for example, a letter sent by post or e-mail).
- The Consumer may use the withdrawal form attached as Appendix No. 1 to the Regulations, but this is not mandatory.
- In the case of withdrawal, the Seller returns all payments received from the Consumer, including delivery costs, no later than 14 days from the date on which the Seller was informed of the decision to withdraw.
- The Consumer bears the direct cost of returning the Goods.
- The right of withdrawal is not available to the Consumer in cases specified in Art. 38 of the Consumer Rights Act, e.g., in the case of:
- goods made to the Consumer’s specification,
- sealed goods which cannot be returned for health or hygiene reasons after opening,
- services fully performed with the Consumer’s consent.
§9 Complaints
- The Seller is obliged to deliver Goods free from defects.
- The Customer may file a complaint by sending it to the email address or postal address of the Seller.
- The complaint should include: order number, data of the Customer, description of the defect, and the Customer’s demand.
- The Seller shall respond to the complaint within 14 days of receiving it.
- If the Goods have a defect, the Customer may demand:
- replacement of the Goods with a defect-free one,
- removal of the defect,
- a reduction in Price,
- withdrawal from the contract (if the defect is material).
§10 Liability
- The Seller is not liable for interruptions in the functioning of the Service caused by force majeure, unauthorized actions of third parties, or incompatibility of the Customer’s system with technical requirements.
- The Seller is liable for non-performance or improper performance of the contract on general principles, unless otherwise provided in the Regulations.
§11 Copyright
- All content posted in the Service, including text, graphics, logos, photos, are the property of the Seller or are used with the consent of authorized persons.
- Copying, distribution, or use for commercial purposes without the consent of the Seller is prohibited.
§12 Personal Data
- The controller of personal data is the Seller.
- Personal data is processed in accordance with applicable law and the Privacy Policy available at https://ateliertwentyone.eu/pl/polityka-prywatnosci.
- The Customer has the right to access, correct, and delete their personal data.
§13 Final Provisions
- The Regulations are available free of charge in the Service.
- The Seller reserves the right to amend the Regulations. Changes apply from the date of their publication in the Service and apply to contracts concluded after this date.
- In matters not regulated by these Regulations, the provisions of Polish law apply, in particular the Civil Code and the Act on Consumer Rights.
- Disputes between the Seller and the Customer will be settled by competent courts in accordance with applicable law.
